Atul Kumar, Founder & Lawyer, Kumar & Kumar Legal (KNK Legal)

Myself, Atul Kumar, the founder and lawyer of Kumar & Kumar Legal (KNK Legal). I did my graduation, B.COM (HONS.) from Delhi University, thereafter pursued my law degree, L.L.B., from the prestigious Campus Law Centre, Faculty of Law, Delhi University. Currently, I am having around 23 years of vast experience of practice in the noble field of law.

My core areas of practice include litigation/arbitration, opinion (related to regulatory bodies like NPPA, GST, CDSCO, FDA, etc.), contracts (drafting and advising for their interpretation and implementation), employment-related matters, other advisory and legal strategy planning, legal documentation, statutory compliances, legal training, etc.

Could you tell us about your venture, Kumar & Kumar Legal (KNK Legal), and the range of legal services it offers to clients?

After handling various legal assignments for multiple clients across different sectors, in the year 2015, my dream Kumar & Kumar Legal (KNK Legal) was launched as a premier full-service provider with a strong commitment to deliver exceptional legal services to our clients. We pride ourselves on our ability to provide innovative and strategic solutions to complex legal issues across various practice areas.

At Kumar & Kumar Legal (KNK Legal), we are committed to providing seamless legal services in all practice areas, including arbitration and litigation, corporate and securities, tender/bid management, competition law, commercial law, pharma law/medical equipment, real estate, oil and gas, IT sector, environmental law, infrastructure, labor and employment, mergers and acquisitions, regulatory matters, and more.

What inspired you to start Kumar & Kumar Legal (KNK Legal), and how has your leadership driven its success?

Like any other entrepreneur, it was my college days dream to start my own venture, to deliver top-quality legal services to our clients with the minimum financial burden. However, in the legal sector, challenges are entirely different from other sectors, especially for first generation lawyer; finances are big constraints, there are certain regulations to adhere and absence of specific government schemes to promote legal sectors; hence, initially it was quite difficult even to arrange the requisite infrastructure, but now I can look back and say it was a very good learning phase for me. So, with my educational background, knowledge, and experience in the legal field as my precious wealth, which enable me to lead the path for Kumar & Kumar Legal (KNK Legal) by delivering top-quality legal services to our clients in the most integral and ethical manner, which is our USP.

Could you share with us your professional journey with key milestones and notable achievements?

As already mentioned, dreaming and establishing Kumar & Kumar Legal (KNK Legal)  was key milestone in my professional journey, there are various notable achievement as well, ironically in complete contrast to general perception like as depicted in movie when Lawyer of one party with his exceptional skills defeated his opponents, strangely for me, notable achievements are when very complex and critical matters of my clients were amicably resolved by dialogue and discussions with opponents in the most cordial manner, not only matters were resolved even their business relationships were re- established, ultimately, either we work for multinational clients/ individuals/ organizations, our first priority is to provide best advice to our clients,  to safeguard their interest,  valuable resources and  time, as we strongly believe that litigation should be the last resort. Sadly, still in our country ecosystem to promote amicable settlements are not very supportive. Sometimes my friends joked me that I was losing opportunities by my habit of promoting out-of-court settlements. Anyway, till the time my clients are benefited, I am also happy.

Could you elaborate on a on a few key projects that Kumar & Kumar Legal (KNK Legal) has successfully handled across various industries?

Since, we worked for various multinational clients in very complex legal environment, which often demand knowledge of various laws of different jurisdictions, as in our experience, proposition  which might be compliant in one jurisdiction may be grey in other jurisdiction, further legal profession requires churning of sensitive information so in our practice confidentiality is paramount, respecting the same it would be difficult to provide specific details here, however so far we had successfully handled various arbitration matters involving  complex interpretations of contracts, for our MNC clients, in some cases it was contested against governments  as well,  interestingly I can recall recent conclusion of  settlement deed for two big multinational organization which eased  them to settle their disputes. A major area of our work also involves preventive or mitigation advisory, through which often we raise red flags, and by timely corrective measures, our clients mitigated potential financial risk and major liabilities.

Of course, litigation is our prime area of practice, beside above unique areas. We are also doing Pro-bono work as token of our contribution towards society, like giving opinion to female employees about their rights especially under POSH, helping budding entrepreneurs mostly SME on their various legal topics, advising in filing RTI etc. so genuinely needed people can contact us.

What are your primary areas of legal expertise, and how have they contributed to your success in handling complex legal matters?

My kind of areas of practice is not just limited to litigations; hence, it requires me to possess a good understanding of legal issues in a multinational environment and a comprehensive understanding of civil laws, commercial laws, corporate law, the Insolvency Act, as well as to be adept at drafting, vetting, and preparing complex agreements, including those having international implications, MOUs, JVs, lease deeds, and giving opinions on various complex topics covering different sectors like pharmaceuticals, medical devices, power, coal, infrastructure, logistics, IT, oil and gas, construction, etc.

In a nutshell, full service means and requires 360-degree knowledge from conceiving the agreement, its execution, interpretation, amicable settlement, and finally, if needed, litigation/ arbitration.

What advice would you give to aspiring lawyers who are looking to specialize in civil and commercial law?

My advice to the budding lawyers pursuing their career in civil and commercial law would be to do your best; never let your self-respect down if you are a first-generation lawyer without Godfather; rather, your responsibility to attain success is much higher as compared to the others. Two important aspects: firstly, update your knowledge through regular reading, and secondly, try to connect with courts, as ultimately the final test of a lawyer's capabilities would be inside the court and not in cozy offices.
